2. Acceptance of Terms

By accessing or using Simsima's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

3. Age Requirement

You must be at least 18 years of age to use Simsima's services. By using our services, you represent and warrant that you are at least 18 years old.

4. Our Services

Simsima provides prepaid eSIM profiles for mobile data for international travel. We serve as the connection between mobile network operators and you.

5. Device Compatibility

To use eSIM technology, your device must be compatible and unlocked.

• It is your responsibility to ensure your device is compatible with eSIM technology prior to purchase.
• We provide a compatibility list on our site; however, it is intended as a guide only and may not be fully up-to-date.
• If your device is not compatible or is locked by another operator after you have purchased your eSIM, we are unable to offer a refund.

6. Receiving Your eSIM

• You will receive your eSIM instantly online immediately after payment is processed, and we will also send it to you via email.
• While delivery is typically instant, technical issues beyond our control (such as those with the network provider) may cause delays. We cannot be held responsible for such occurrences.

7. Activation and Expiration

• Your data plan activates automatically the first time your eSIM connects to a supported international network.
• You have 180 days from the date of purchase to set up and activate your eSIM. After this period, the profile may be deactivated, and we are unable to provide a refund.

8. Refunds and Right of Withdrawal

In compliance with EU regulations for digital services:

• Right of Withdrawal: Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day right of withdrawal from the date of purchase.
• Digital Content Exception: By purchasing and installing an eSIM, you expressly consent to the immediate provision of digital content and acknowledge that you lose your right of withdrawal once the eSIM has been installed or activated on your device.
• We are only able to provide a refund if the eSIM has not been used or activated. Once the eSIM is active or data has been utilized, no refunds will be issued.
• To request a refund for an unused eSIM, please contact us at [email protected] within 14 days of purchase.
• If you accidentally delete your eSIM profile, please be assured that you can reinstall it free of charge, provided your plan remains valid.

9. Pricing and Payments

• All prices are stated in US Dollars (USD).
• You may make payments in USD, AUD, CAD, EUR, GBP, or JPY.
• We accept payments via Stripe (Cards, Apple Pay, Google Pay, Alipay, WeChat Pay).
• Prices are inclusive of all applicable taxes. We handle VAT in accordance with applicable regulations.

10. Fair Use and Sharing

• You may use your eSIM for tethering with all our data plans, unless otherwise specified by the local operator.
• For our 'unlimited' data plans (Daily Unlimited), a fair usage policy applies. Should usage significantly exceed typical parameters, the local operator may reduce data speeds to ensure fair access for all users.

11. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the Simsima website and application are the property of Simsima or its licensors and are protected by applicable intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any content on our platform without our prior written consent.
• The Simsima name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Simsima. You must not use such marks without our prior written permission.

12. Prohibited Uses

When using our services, you agree not to:

• Resell, redistribute, or commercially exploit eSIM profiles purchased from Simsima.
• Use our services for any unlawful purpose or in violation of any applicable local, national, or international law.
• Attempt to gain unauthorized access to our systems, networks, or other users' data.
• Engage in any activity that disrupts or interferes with the proper functioning of our services or the networks of our partner operators.
• Use our services in a manner that could damage, disable, or impair our infrastructure.

13. Limitation of Liability

• We are not responsible for the quality, coverage, or any service interruptions provided by local operators in the visited countries.
• We are not liable for internet outages resulting from government decisions, natural disasters, or significant political instability.

14. Termination

We reserve the right to suspend or terminate your access to our services, without prior notice, if:

• You violate any provision of these Terms of Service.
• We are required to do so by law or regulatory authority.
• We reasonably believe your use of the service poses a security risk or may cause harm to other users or third parties.
• Upon termination, your right to use the services will immediately cease. Any unused eSIM data may be forfeited.

15. Modification of Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify you by updating the date at the top of these terms and, where appropriate, by sending you an email notification. Your continued use of our services after any changes constitutes your acceptance of the updated terms.

16. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Any disputes arising from these Terms will be resolved in the courts of Barcelona, Spain. For EU consumers: You may consult the European Commission's directory of dispute resolution bodies at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simsima regarding your use of our services.
