2Acceptance of Terms

By accessing or using Simsima's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

3Age Requirement

You must be at least 18 years of age to use Simsima's services. By using our services, you represent and warrant that you are at least 18 years old.

4Our Services

Simsima provides prepaid eSIM profiles for mobile data for international travel. We serve as the connection between mobile network operators and you.

5Device Compatibility

To use eSIM technology, your device must be compatible and unlocked.

• It is your responsibility to ensure your device is compatible with eSIM technology prior to purchase.
• We provide a compatibility list on our site; however, it is intended as a guide only and may not be fully up-to-date.
• If your device turns out to be incompatible or locked by another operator, the eSIM cannot be activated on it; it remains refundable under section 8 if you contact us within 14 days of purchase.

6Receiving Your eSIM

• You will receive your eSIM instantly online immediately after payment is processed, and we will also send it to you via email.
• While delivery is typically instant, technical issues beyond our control (such as those with the network provider) may cause delays. We cannot be held responsible for such occurrences.

7Activation and Expiration

• Your data plan activates automatically the first time your eSIM connects to a supported network at your destination. Installing the eSIM does not start its validity. A regional or Global plan activates as soon as it connects if you are already in a country it covers.
• You have 180 days from the date of purchase to set up and activate your eSIM. After this period, the profile may be deactivated, and we are unable to provide a refund.

8Refunds and Right of Withdrawal

In compliance with EU regulations for digital services:

• Right of Withdrawal: Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day right of withdrawal from the date of purchase.
• Digital Content Exception: By purchasing an eSIM, you expressly consent to the immediate provision of digital content and acknowledge that you lose your right of withdrawal once the eSIM has been activated, that is, once it has connected to a mobile network. An eSIM that is installed on your device but not yet activated remains refundable within 14 days of purchase.
• We are only able to provide a refund if the eSIM has not been used or activated. Once the eSIM is active or data has been utilized, no refunds will be issued.
• To request a refund for an eSIM that has not been activated, please contact us at [email protected] within 14 days of purchase.
• If you delete your eSIM profile from your device, you cannot reinstall it yourself. Contact us at [email protected] and we will review your case.

9Pricing and Payments

• Prices are displayed and charged in the currency shown at checkout. It is selected according to your language, and you can change it on our site.
• Available currencies: USD, EUR, GBP, CAD, AUD, JPY, KRW, CHF, BRL, SEK, DKK, NOK, TWD, CNY, and INR.
• We accept payments via Stripe (Cards, Apple Pay, Google Pay, Alipay, WeChat Pay) and NOWPayments (cryptocurrency, on eligible orders).
• Prices are inclusive of all applicable taxes. We handle VAT in accordance with applicable regulations.

10SimCoins and Cashback

• Every eSIM purchase earns 4% of the amount paid back in SimCoins, our loyalty currency. 100 SimCoins are worth €1.
• SimCoins are credited once your eSIM becomes active, not at the time of purchase. An eSIM that is never activated earns no SimCoins.
• Each batch of SimCoins is valid for 12 months from the day it is credited. When you spend SimCoins, the batch closest to expiry is used first.
• SimCoins can cover up to 100% of a future order. They have no cash value, cannot be withdrawn or transferred, and are forfeited if you delete your account.
• Cashback does not combine with a partner promo code: when such a code is applied, the order earns no SimCoins. The checkout states this before payment. Referral codes do not affect cashback.
• If an order is canceled or refunded, the SimCoins earned on it are reversed. If they have already been spent, we deduct what remains of that batch.
• Referral: the person you refer receives a 3% discount on their first order, capped at €3, and you earn 10% of that first order in SimCoins, capped at 500 SimCoins (€5) per referral. The referred person's first order must be at least €15.
• We may change the cashback rate, the validity period and the referral terms at any time. Changes apply to SimCoins earned after the change; SimCoins already credited keep the validity period that applied when they were earned.

11Fair Use and Sharing

• You may use your eSIM for tethering with all our data plans, unless otherwise specified by the local operator.
• For our 'unlimited' data plans (Daily Unlimited), a fair usage policy applies. Should usage significantly exceed typical parameters, the local operator may reduce data speeds to ensure fair access for all users.

12Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the Simsima website and application are the property of Simsima or its licensors and are protected by applicable intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any content on our platform without our prior written consent.
• The Simsima name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Simsima. You must not use such marks without our prior written permission.

13Prohibited Uses

When using our services, you agree not to:

• Resell, redistribute, or commercially exploit eSIM profiles purchased from Simsima.
• Use our services for any unlawful purpose or in violation of any applicable local, national, or international law.
• Attempt to gain unauthorized access to our systems, networks, or other users' data.
• Engage in any activity that disrupts or interferes with the proper functioning of our services or the networks of our partner operators.
• Use our services in a manner that could damage, disable, or impair our infrastructure.

14Limitation of Liability

• We are not responsible for the quality, coverage, or any service interruptions provided by local operators in the visited countries.
• We are not liable for internet outages resulting from government decisions, natural disasters, or significant political instability.

15Termination

We reserve the right to suspend or terminate your access to our services, without prior notice, if:

• You violate any provision of these Terms of Service.
• We are required to do so by law or regulatory authority.
• We reasonably believe your use of the service poses a security risk or may cause harm to other users or third parties.
• Upon termination, your right to use the services will immediately cease. Any unused eSIM data may be forfeited.

16Modification of Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify you by updating the date at the top of these terms and, where appropriate, by sending you an email notification. Your continued use of our services after any changes constitutes your acceptance of the updated terms.

17Governing Law and Jurisdiction

These Terms are governed by Spanish law. Any disputes arising from these Terms will be resolved in the courts of Barcelona, Spain. For EU consumers: You may consult the European Commission's directory of dispute resolution bodies at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simsima regarding your use of our services.
